Twitter Making Pre-Trial Process Impossible, Say Elon Musk’s Lawyers
After Elon Musk announced plans to countersue Twitter over his backing out of a $44 billion purchase, the billionaire’s lawyers have said the social media company is purposely making the pre-trial process impossible.
Tesla’s lawyers have expressed that Twitter is making the pre-trial process extremely difficult, by not reciprocating necessary materials to cooperate with Chancellor Kathaleen McCormick’s move to have the trial begin by October, according to The Verge.
Earlier this month, Chancellor McCormick ruled that the trial would start in October, after Twitter pushed to begin proceedings as soon as possible, while Musk has pushed to wait until 2023 to begin the trial.

Now, Musk’s lawyers say Twitter is thwarting attempts to be trial-ready by October, despite the fact that the company originally initiated attempts to get the trial over with sooner, rather than later.
In a letter to Chancellor McCormick, Musk’s lawyers wrote, “Defendants’ efforts to make sure this case is trial-ready by October, have not been reciprocated by Twitter, who at every turn has sought to delay.”
The basis of the argument rests on three points: the inability of the two parties to agree on a specific trial date, Twitter not producing necessary documents for pre-trial and Twitter not producing the raw data necessary for the trial — which Musk says the team needs by August 1.
