Tesla Hires Former SEC Attorney as New Managing Counsel

Tesla has hired a new managing counsel, according to CNBC. David Misler, a former attorney for the Securities and Exchange Commission and U.S. Department of Justice joined the electric automaker back in October, according to his LinkedIn.

“Today, a new journey begins. I start at #Tesla as a managing counsel for litigation where I will support our important mission of accelerating the world’s transition to sustainable energy. I am excited to join such an innovative and disruptive company and am ready for the opportunities and challenges ahead,” wrote Misler in October.

Tesla CEO Elon Musk and his Twitter account have had previous run-ins with the SEC. Back in 2018, Musk said there was “funding secured” for taking Tesla private at $420 per share, but that never happened.

In the end, Tesla and Musk agreed to pay fines totalling $40 million, plus also have the leader resign as chair of the board and have his tweets monitored before publishing.

“Almost nine years ago, I joined the U.S. Attorney’s Office in Washington, D.C. where I took an oath that I would faithfully represent the United States as its counsel. My federal service ended this past Friday after two years in the Securities and Exchange Commission’s trial unit,” detailed Misler, who went to the
University of Maryland Francis King Carey School of Law.

With a former SEC and DOJ attorney on board at Tesla as its managing counsel, the company will likely have better insight on legal matters related to the federal government.

Misner’s LinkedIn states he has been working for Tesla since October, out of Washington, D.C.
